1. Who we are

Creafi is provided by Creafi ("Creafi", "we", "us"). You can reach us at hello@creafi.xyz.

"You" means the person or organisation that creates an account. If you use Creafi on behalf of a company, you confirm you are authorised to accept these terms for it, and "you" includes that company.

2. Accepting these terms

By creating an account or using Creafi you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old, or the age of majority where you live, to create an account.

3. What Creafi does

Creafi is an AI studio for building and running a business. Depending on your plan it lets you create a brand identity, websites, online stores, designs, presentations, social and marketing content, newsletters and analytics, and work with AI agents that share the same business context.

Some features depend on third-party services such as payment processors, domain registrars, email delivery and AI model providers. When you use them, their own terms may also apply.

We improve Creafi continuously. We may add, change or remove features. If we remove a feature that is a material part of a paid plan you are on, we will tell you in advance and you can cancel.

4. Your account

Give us accurate information and keep it up to date. Keep your login details secret and tell us straight away if you think someone has accessed your account.

You are responsible for what happens in your account, including actions by team members you invite.

5. Plans, payments and renewals

Creafi has a free plan and paid plans. Prices, included AI credits and features are shown on the pricing page at the time you buy. Prices are shown in US dollars unless stated otherwise; taxes are added where required.

Paid plans are billed in advance for each billing period and renew automatically until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period and you keep access until then.

If a payment fails we may retry it and, after notifying you, limit paid features until the balance is settled.

If we change the price of your plan, we will tell you at least 30 days before the change applies to your next renewal. If you don't agree, you can cancel before then.

6. Right of withdrawal for consumers

If you are a consumer in the European Union, you normally have 14 days from purchase to withdraw from a paid subscription without giving a reason, by writing to us.

When you buy, you can ask us to start the service immediately. In that case you acknowledge that, if you withdraw, you pay for the service provided up to that point, and that AI credits you have already used cannot be returned.

This section does not apply to business customers.

7. AI credits

Many AI features consume credits. Each plan includes a number of credits per billing period, and the app shows how many a task will use before or while you run it.

Unless your plan says otherwise, included credits reset at each renewal and do not roll over. Credits have no cash value, cannot be transferred and are not refundable except where the law requires it.

8. Your content

You keep ownership of everything you upload or create in Creafi: texts, images, product data, brand assets, websites and so on ("your content").

You give us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display your content only as needed to run Creafi for you, for example to publish your website or generate a design from your brand. This licence ends when you delete the content or your account, except for copies we must keep by law or that are in routine backups for a limited time.

You confirm you have the rights needed for the content you upload, and that it does not infringe anyone else's rights.

9. Content generated with AI

Between you and Creafi, the output generated for you is yours to use, subject to these terms and to the rights of third parties.

AI output can be inaccurate, incomplete or similar to content produced for other users. Check it before you publish or rely on it, especially for legal, financial, health or safety matters. You are responsible for how you use it.

We do not use your private content to train general-purpose AI models without your permission.

10. Acceptable use

You agree not to use Creafi to:

• break the law or help others do so, including consumer, advertising and data protection law;
• publish content that is illegal, deceptive, hateful, violent, sexually exploitative or that infringes intellectual property or privacy;
• send spam or unsolicited messages, or run phishing and scams;
• sell prohibited or dangerous products through a Creafi store;
• attack, overload, reverse engineer or bypass the security or usage limits of the service;
• resell or give access to Creafi to third parties outside the features your plan allows.

11. Your websites, stores and customers

When you sell through a Creafi website or store, you are the seller. The contract of sale is between you and your customers, and you are responsible for your products, prices, taxes, shipping, returns, customer service and the legal pages of your own site.

Payments to your store are processed by our payment partners under their terms. Creafi is not a party to those transactions.

12. Domains and hosting

Domains registered through Creafi are registered in your name with an accredited registrar and are subject to the registrar's rules. Renew them on time: an expired domain may be lost.

If you close your account, you can transfer your domain away following the registrar's procedure.

13. Creafi's intellectual property

Creafi's software, design, brand and documentation belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use Creafi under these terms. Templates and assets we provide can be used within your Creafi projects.

If you send us feedback, we may use it to improve Creafi without owing you anything.

14. Availability and support

We work to keep Creafi available and secure, but we cannot guarantee it will be uninterrupted or error-free. We may need planned maintenance; when possible we will announce it.

Keep your own copies of important content. You can export your data where the app offers export.

15. Suspension and termination

You can delete your account at any time.

We may suspend or close an account that seriously or repeatedly breaks these terms, puts other users or Creafi at risk, or is required to be closed by law. Where reasonable we will warn you first and give you a chance to fix the problem and to export your content.

16. Liability

Nothing in these terms limits liability that cannot be limited by law, including for fraud, gross negligence, wilful misconduct, or death and personal injury, or your statutory rights as a consumer.

Otherwise, to the extent allowed by law, Creafi is not liable for indirect losses such as lost profits, lost revenue or loss of data you could have backed up, and our total liability to business customers for any claim is limited to the amounts you paid us in the 12 months before the event that caused it.

17. Your responsibility towards third parties

If you are a business customer and a third party brings a claim against Creafi because of your content, your store or your breach of these terms, you agree to cover the reasonable costs and damages that result.

18. Privacy

We process personal data as described in our Privacy Policy. When you use Creafi to process personal data of your own customers, you are the controller of that data and we act as your processor under the data processing terms available on request.

19. Changes to these terms

We may update these terms, for example when we launch new features or the law changes. We will tell you about material changes by email or in the app at least 30 days before they take effect. If you keep using Creafi after that date, the new terms apply; if you don't agree, you can cancel.

20. Applicable law and disputes

These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim before the courts of your place of residence.

For business customers, the courts of the city where Creafi has its registered office have exclusive jurisdiction.

Before going to court, write to us: most problems can be solved quickly. EU consumers can also use the European Commission's online dispute resolution platform.
